ESTATE PLANNING AND PROBATE MATTERS Estate Planning: Individuals have varying estates and estate planning needs. Individuals may need a last will and testament or a revocable living trust. I advise individuals on the best approach based upon the types and values of their assets (including life insurance and retirement accounts), family dynamics, and tax consequences. Individuals may also need tools to help them in their need of incapacity such as financial and medical powers of attorney, directives to physicians (“living will”), and guardianship designations. Probate: Probate is the legal process of determining the authenticity of the decedent’s will, handling the debts of the decedent’s estate, and distributing the decedent’s assets to the named beneficiaries. Estate administration may, in addition to the probate process, include distributing non-probate assets to the designated beneficiary or may include the identification of heirs and distribution of a decedent’s assets when the decedent did not have a last will and testament. State laws direct how to distribute assets in that event.
