DEBTOR AND CREDITOR MATTERS This office provides debt relief services.  We help consumers file for bankruptcy relief under the federal bankruptcy laws. Bankruptcy: Chapter 7 bankruptcy is the United States Bankruptcy Code’s liquidation chapter. It is used by individuals who want to free themselves of debt relatively simply and inexpensively. Businesses may use it to liquidate and terminate their businesses. Chapter 13 bankruptcy is a “payment plan” bankruptcy and is used only by individuals to pay out debts over a 3-5 year period in order to perhaps save their home, work out payments with the IRS, to keep assets that might be lost in a chapter 7 bankruptcy, and perhaps because they do not qualify for a chapter 7 bankruptcy due to income level. I represent individual and business debtors in chapter 7 cases and individual and business creditors in chapter 13 cases. Debtor/Creditor Matters: Some individuals and businesses have debt, but are not in a position to file a bankruptcy. These clients may need the skills of an attorney in negotiationing a settlement of the debt(s) or defending a lawsuit filed by a creditor. Other individuals and businesses need assistance to prepare documentation of a debt such as a promissory note or contract which would allow them to collect upon debt in event of default. Some need assistance in the foreclosure process-upon either real estate or personal property.
